IIRC about the Facebook case with New York — the court ruled that the individuals had to bring their case severally (by themselves). The problem is that Facebook had a gag order, so they couldn’t tell the users that their information had been shared.
This is also common with the NSL (National Security Letters) that the FBI and DHS use to scoop information
I think you can understand the gag order in this case (it would give away to those you were investigating that you were onto them so they could start destroying other evidence). It’s a bit like a regular search warrant – the cops don’t usually phone first to make an appointment for a time they can pop round 🙂 But I can see Facebook’s side too: their argument seems to be that the Fourth is supposed to inhibit unreasonable search, not merely to prevent the results of unreasonable search being used in court (if indeed the case ever comes to court).
